Homestalgia is operated by Homestalgia Media Group, LLC, a limited liability company formed in the State of Delaware, United States. When these terms refer to "the service", they mean the Homestalgia website at www.homestalgia.com, the property profiles and stories published on it, The Dailies, and the Agent Studio subscription product.

By creating an account, submitting a story, or otherwise continuing to use the service, you agree to these terms. If you are using the service on behalf of a brokerage or other organization, you confirm you have authority to bind that organization. If you are using it as an individual, you confirm you are of legal age to form a binding contract where you live.

You are responsible for keeping your account credentials confidential and for all activity that happens under your account. Please give us accurate information and keep it current, particularly the contact details we use for billing and service notices.

You agree not to misuse the service. Specifically, you must not:

• Use the service for any unlawful purpose, or in violation of fair housing, real estate advertising, or consumer protection law.
• Commit fraud, send spam, impersonate another person, or falsely claim a connection to a property or household you have no relationship with.
• Upload photos, text, or media you do not have the rights to publish, or that infringe anyone's intellectual property or privacy.
• Post content that harasses, threatens, or exposes private information about the current or former occupants of a home.
• Interfere with the security of the service, no malware, probing, penetration testing, credential stuffing, scraping, or automated bulk collection of property or user data.
• Reverse engineer the service, resell or redistribute it, or circumvent plan limits or technical restrictions.

You keep ownership of the stories, photos, and other content you contribute. You grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, adapt for display, and publish that content on the service and in Homestalgia marketing of the service, for as long as you keep it posted. Stories you mark private are shown only to you and to people you explicitly share them with.

Homes are shared places. If a story about a property you occupy is inaccurate, invasive, or should not be public, use the report link on the story or email support@homestalgia.com and we will review it. We may remove, restrict, or unpublish content at our discretion, particularly where there is a credible claim of infringement, harassment, or privacy harm. Repeat infringers lose access.

Property facts, valuations, listing status, imagery, and neighborhood data come from public records, third-party data providers, and users. They may be incomplete, out of date, or wrong. Nothing on Homestalgia is an appraisal, a listing agreement, or legal, tax, or investment advice. Verify anything you intend to rely on for a real estate transaction.

We retain all rights in the service itself, the software, design, editorial content we produce, the Homestalgia name, and our branding. Subject to these terms, we grant you a limited, non-exclusive, non-transferable right to use the service within the plan you have selected.

We work hard to keep Homestalgia available, but we do not guarantee that the service will be uninterrupted, timely, secure, or error-free. To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.

Agent Studio is sold on a subscription basis. Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

Payment, billing frequency, renewal, tax, cancellation, and refund mechanics are governed by Paddle's Buyer Terms. Subscriptions renew automatically at the interval you selected until cancelled. You can cancel at any time from Plans & Billing in Agent Studio, and your plan stays active through the end of the paid period. See our Refund Policy for our money-back guarantee.

We may suspend or terminate access to the service where:

• you materially breach these terms;
• payment for a subscription fails and is not resolved;
• your account presents a security or fraud risk to us, to other users, or to homeowners; or
• you repeatedly or seriously violate our acceptable use rules.

You may close your account at any time. When access ends, you have 30 days to export your stories and listing content, after which we may delete or anonymize it in line with our Privacy Notice.

To the fullest extent permitted by law, neither party is liable for indirect, consequential, or special damages, including lost profits, lost data, or lost goodwill. Our aggregate liability arising out of the service is capped at the fees you paid us in the twelve months before the event giving rise to the claim. Nothing in these terms limits liability for fraud, death, or personal injury caused by negligence, or any other liability that cannot be limited by law.

You will indemnify us against third-party claims arising from content you submit, your unlawful use of the service, or your breach of these terms.

We may update these terms as the service changes. Material changes will be announced on the service or by email before they take effect. Continuing to use Homestalgia after that means you accept the updated terms.

These terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-law rules, and the state and federal courts located in Delaware have exclusive jurisdiction over disputes. You may not assign these terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets. Neither party is liable for delays caused by events beyond its reasonable control.
